Introduction

Baker Engineering, LLC, a wholly owned subsidiary of Waséyabek Development Company, LLC (referred to as “Baker” or “we,” “us,” or “our”) is committed to protecting and respecting your privacy and will only use Personal Information in accordance with the terms of this Privacy Policy (“Policy”)  This Policy explains how we collect, use, disclose, and safeguard your information when you visit our website bakerengineering.com, including any other media form, media channel, mobile website, or mobile application related or connected thereto (collectively, the “Site”). You can access the Site in many ways, including from a computer or mobile phone, and this Policy will apply regardless of the means of access.

Information We Collect

Our Site collects information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or device (“Personal Information”).

Where applicable, we indicate whether and why you must provide us with your Personal Information, as well as the consequences of failing to do so.  If you do not provide Personal Information when requested, you may not be able to benefit from our Site if that information in necessary to provide you with the applicable services or we are legally required to collect it.  The Personal Information that we collect includes:

Personal Data

Personally identifiable information, such as your name, shipping address, email address, telephone number, and demographic information, such as your age, gender, hometown, and interests, that you voluntarily give to us when you register with the Site or when you choose to participate in various activities related to the Site, such as online chat and messaging. You are under no obligation to provide us with Personal Information of any kind, however your refusal to do so may prevent you from using certain features of the Site.

Derivative Data

Information our servers automatically collect when you access the Site, such as your IP address, your browser type, your operating system, your access times, and the pages you have viewed directly before and after accessing the Site.

Financial Data

Financial information, such as data related to your payment method (e.g., valid credit card number, card brand, expiration date) that we may collect when you purchase, order, return, exchange, or request information about our services or products from the Site. We store only very limited, if any, financial information that we collect. Otherwise, all financial information is stored by our payment processor, Authorize.net, and you are encouraged to review their privacy policy and contact them directly for responses to your questions.

Mobile Device Data

Device information, such as your mobile device ID, model, and manufacturer, and information about the location of your device, if you access the Site from a mobile device.

Third-Party Data

Information from third parties, such as personal information or network friends, if you connect your account to the third party and grant the Site permission to access this information.

When you use our Site, you may choose to provide certain information directly to us to request more information about our services or products or for other reasons.  We will collect, use, share and store this Personal Information consistent with this policy.

Use of Your Information

Marketing Purposes

We may use the information we collect for our own marketing purposes including notifying you of special promotions, offers, and events via push notifications, e-mail and other means, including SMS messaging, subject to compliance with applicable laws.  If you do not want us to use your personal information for marketing purposes you may opt-out in accordance with the “Email Communications” section below.

IF YOU PROVIDE A CELL PHONE NUMBER AND EXPRESSLY CONSENT TO RECEIVE SMS MESSAGES FROM BAKER, YOU EXPRESSLY CONSENT TO RECEIVING SMS MESSAGES FROM BAKER THE PURPOSE OF WHICH IS TO MARKET BAKER, OUR SERVICES, AND OUR PRODUCTS.  ALTHOUGH THERE IS NO FEE ASSOCIATED WITH THIS SERVICE, YOUR CARRIER MAY CHARGE YOU FOR EACH MESSAGE YOU RECEIVE IN ACCORDANCE WITH YOUR CALLING PLAN.  YOU AGREE THAT WE ARE NOT RESPONSIBLE IN ANY WAY FOR SUCH CHARGES.  IF YOU DO NOT WISH TO CONTINUE TO RECEIVE ANY MESSAGE VIA YOUR MOBILE DEVICE, YOU MAY OPT-OUT AT ANY TIME BY CONTACTING US AT info@bakerengineering.com OR BY TEXTING “STOP” IN RESPONSE TO A MARKETING SMS MESSAGE YOU RECEIVE FROM BAKER.  FAILURE TO OPT-OUT CONSTITUTES YOUR CONSENT TO CONTINUE TO RECEIVE THESE MESSAGES UNTIL YOU ELECT TO OPT-OUT.

Non-Marketing Purposes

We may use the information we collect for non-marketing purposes including (1) validating your identity; (2) sending you push notifications or e-mails to provide you with alerts and updates about your account and the Site; (3) conducting statistical or demographic analysis; (4) complying with legal and regulatory requirements; (5) customizing your experience with the Site; (6) protecting and defending Baker (which includes the Waséyabek portfolio) against legal actions or claims; (7) preventing fraud; (8) debt collection; (9) satisfying contractual obligations; (10) cooperating with law enforcement or other government agencies for purposes of investigations, national security, public safety, or matters of public importance when we believe that disclosure of information is necessary or appropriate to protect the public interest; and (11) for other business purposes permitted under applicable law (collectively, the “Non-Marketing Purposes”).

Baker will not collect additional categories of Personal Information or use Personal Information we collect for materially different, unrelated or incompatible purposes without providing you notice.

We may share the information we collect with our business partners and other third parties for Non-Marketing Purposes and joint marketing purposes.  We require that these parties agree to process such information in compliance with this Policy and use appropriate confidentiality and security measures, and we use reasonable efforts to limit their use of such information. 

Certain Business Transactions

We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.

We may share your information with third parties that perform services for us or on our behalf, including payment processing, data analysis, email delivery, hosting services, customer service, and marketing assistance.

With your consent, or with an opportunity for you to withdraw consent, we may share your information with third parties for marketing purposes, as permitted by law.

We may share your information with our affiliates, in which case we will require those affiliates to honor this Policy. Affiliates include our parent company and any subsidiaries, joint venture partners, or other companies that we control or that are under common control with us.

Sale or Bankruptcy

If we reorganize or sell all or a portion of our assets, undergo a merger, or are acquired by another entity, we may transfer your information to the successor entity. If we go out of business or enter bankruptcy, your information would be an asset transferred or acquired by a third party. Baker cooperates with government and law enforcement officials or private parties to enforce and comply with the law.  To the extent permitted under applicable law, we may disclose any information about you to government or law enforcement officials or private parties as we believe is necessary or appropriate to investigate, respond to and defend against legal claims, for legal process (including subpoenas), to protect the property and rights of Baker or a third party, to protect Baker against liability, for the safety of the public or any person, to prevent or stop any illegal, unethical, fraudulent, abusive, or legally actionable activity, to protect the security or integrity of the Site, Baker’s services or products, or to comply with the law.

Tracking Technologies

Cookies and Web Beacons

We may use cookies, web beacons, tracking pixels, and other tracking technologies on the Site to help customize the Site and improve your experience. When you access the Site, your personal information is not collected through the use of tracking technology. Most browsers are set to accept cookies by default. You can remove or reject cookies, but be aware that such action could affect the availability and functionality of the Site.

Internet-Based Advertising

We do not control third parties’ collection or use of your Personal Information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your Personal Information collected or used in this way. You can opt out of receiving targeted ads from members of the Network Advertising Initiative (“NAI”) on the NAI’s website, located at https://networkadvertising.org.

Website Analytics

We may also partner with selected third-party vendors, such as Google Analytics, to allow tracking technologies on the Site through the use of first party cookies and third-party cookies, to, among other things, analyze and track users’ use of the Site, determine the popularity of certain content, and better understand online activity. By accessing the Site, you consent to the collection and use of your information by these third-party vendors. You are encouraged to review their privacy policy and contact them directly for responses to your questions. We do not transfer personal information to these third-party vendors. However, if you do not want any information to be collected and used by tracking technologies, you can visit the third-party vendor or the NAI’s website, located at https://networkadvertising.org.

The Site may contain links to third-party websites and applications of interest, including advertisements and external services, that are not affiliated with us. Once you have used these links to leave the Site, any information you provide to these third parties is not covered by this Policy, and we cannot guarantee the safety and privacy of your information. Before visiting and providing any information to any third-party websites, you should inform yourself of the privacy policies and practices (if any) of the third party responsible for that website, and should take those steps necessary to, in your discretion, protect the privacy of your information. We are not responsible for the content or privacy and security practices and policies of any third parties, including other sites, services, or applications that may be linked to or from the Site.

Security of Your Information

We use administrative, technical, and physical security measures to help protect your personal information. While we have taken reasonable steps to secure the personal information you provide to us, please be aware that despite our efforts, no security measures are perfect or impenetrable, and no method of data transmission can be guaranteed against any interception or other type of misuse. Any information disclosed online is vulnerable to interception and misuse by unauthorized parties. Therefore, we cannot guarantee complete security if you provide personal information.

International Transfers

Information collected on the Site may be stored and processed in any country in which we or our affiliates, suppliers, third-party electronic payment processors and/or financial institutions or agents maintain facilities.  By using the Site, you expressly consent to any transfer of information outside of the U.S. (including to countries that may not have been assessed as having adequate privacy laws).

Notice to EU Residents

This Policy applies only to the Site and does not govern the separate websites, applications, platforms, and services of affiliates or any third parties that may link to or be linked to/from the Site.  In addition to the terms of the Policy, under the General Data Protection Regulation (“GDPR”), you have the right to access and request information from us regarding the personal information we collect about you, rectification of that information, the portability of that information, and to restrict (or withdraw consent as it relates to) the use of that information (see “Use of Your Information Section” above).  To correct any inaccuracies of your Personal Information, please contact us using the information in the “Contact Us” section below.  We will respond to your request free of charge, although you may be charged if the request will result in an undue burden to us or is excessive.

In certain circumstances, we may not be able to respond to a particular request where (1) we are complying with Non-Marketing Purposes; (2) the request will have an adverse affect on the privacy, health or safety of others; or (3) as otherwise prohibited by applicable privacy and data protection laws.  Where you make a request in respect of your rights we will require proof of identification.  We may also ask that you clarify your request.  If we receive repeated requests or have reason to believe requests are being made unreasonably we reserve the right not to respond.

We will always take reasonable steps to protect your Personal Information from misuse, loss, and unauthorized access or disclosure.  Please be aware that while we have safeguards in place, there are inherent security risks associated with transmitting information, including personal information, across the Internet.  You accept the inherent security risks of providing information over the Internet and will not hold us responsible for any breach of security.

In connection with any provision of services or your use of the Site, we may need to transfer data (including your Personal Information) to other companies in the Waséyabek portfolio and our partners and subcontractors who are based in the European Economic Area (“EEA”).  Our company is committed to do so under standard contractual clauses or binding corporate rules or any other acceptable method that ensures a protection of your Personal Information to the standard required within the EEA. 

Should you have an issue with the manner in which we manage our Policy or feel that we have not complied with applicable data protection laws, you may contact us using the information provided in this Policy and we will investigate the matter.  If you are not satisfied with our response, or you prefer not to contact us, you have the right to file a complaint with the applicable data protection authority in your country.

Policy for Children

We do not knowingly solicit information from or market to children under the age of 13. If we learn that we have collected personal information from a child under age 13 without verification of parental consent, we will delete that information as quickly as possible. Shine the Light Disclosures

California Civil Code Section 1798.83 permits visitor to our Site who are California residents to request certain information regarding our disclosure of personal information regarding our disclosure of personal information to third parties for their direct marketing purposes.  To make such a request, please send an email to us at info@bakerengineering.com.

California Consumer Privacy Act Disclosures

Privacy Information for NevAda Residents

Under Nevada law, certain Nevada consumers may opt out of the sale of “covered information” for monetary consideration to a person for that person to license or sell such information to additional persons.  “Covered information” includes first and last name, address, email address, phone number, Social Security Number, or an identifier that allows a specific person to be contacted either physically or online.

We do not engage in such activity, however, if you are a Nevada resident who has used our Site, you may submit a request to opt out of any potential future sales under Nevada law by contacting info@bakerengineering.com.  Please note we will take reasonable steps to verify your identity and the authenticity of the request.  Once verified, we will maintain your request in the event our practice change.

Email Communications

If you do not wish to have your contact information used by Baker for promotional purposes associated with the Site, or any services or products offered by Baker, you can opt-out by sending us an email stating your request to info@bakerengineering.com.  Additionally, if we have sent you a promotional email, you may click the “unsubscribe” link in the email or send us a return email asking to be omitted from future email distributions.  Please note, this opt-out only applies to our use and sharing of your Personal Information for marketing purposes; we may still use and share Personal Information for Non-Marketing Purposes.
